1. Overview

TravelBuilderPro is a professional travel agency SaaS platform designed to help travel agencies create multi-language itineraries, manage clients and leads, organize suppliers, and generate branded travel proposals.

TravelBuilderPro operates on a freemium model. Users can sign up to a free forever plan, and may optionally upgrade to a paid plan for additional features.

2. Accounts

To use TravelBuilderPro, you must provide accurate information, including your organization name, contact details, and — if you upgrade to a paid plan — payment information.

By subscribing to a paid plan, you agree to pay any applicable fees based on our per-seat billing model. Each user seat requires a separate subscription fee.

3. Free Plan, 7-Day Trial & Paid Subscriptions

Free plan. The Free plan is forever-free and does not require a subscription or payment information. It includes the ability to list your trips on our network of niche travel sites and receive inbound leads (beta), within the limits described on the pricing page.

7-day trial. Every new account starts with a 7-day full-feature trial during which all paid features are unlocked. No credit card is required to start the trial. At the end of the 7 days, your workspace automatically continues on the Free plan unless you upgrade — nothing is suspended and your account remains active.

Paid subscriptions. Paid plans are billed per user seat on a monthly or annual basis. You may upgrade at any time from the trial or from the Free plan, and may cancel at any time from your workspace.

If your account remains inactive for an extended period, we may contact you and, after additional notice, archive or delete inactive Free workspaces in line with our data retention policy described in the Privacy Policy.

4. Data Collection

TravelBuilderPro collects and stores the following types of data:

Account Information: Organization details, user names, email addresses, and billing information
Client Data: Contact information, travel preferences, trip details, and payment records that you input into the platform
Usage Data: Non-personal data including cookies, IP addresses, and analytics to improve our services

TravelBuilderPro is fully compliant with the General Data Protection Regulation (GDPR). As a user of TravelBuilderPro, you acknowledge that:

Data Controller vs. Data Processor Roles

You (the travel agency) are the data controller for all client and travel data you input into TravelBuilderPro
TravelBuilderPro acts as a data processor, processing data on your behalf according to your instructions

Your Responsibilities as Data Controller

As the data controller, you are responsible for:

Obtaining Consent: You must obtain explicit consent from your clients before collecting and processing their personal data
Providing Information: You must inform your clients about what data is collected, why it's collected, and how it will be used
Honoring Data Subject Rights: You must respond to client requests for data access, correction, deletion, or portability
Legal Compliance: You must ensure your use of TravelBuilderPro complies with applicable data protection laws in your jurisdiction

TravelBuilderPro's Responsibilities as Data Processor

TravelBuilderPro will:

Process Data as Instructed: We only process your data according to your instructions and this agreement
Ensure Data Security: We implement appropriate technical and organizational measures to protect your data
Assist with Compliance: We will assist you in meeting your GDPR obligations, including providing data export tools
Maintain Confidentiality: We will not access, use, or disclose your data except as necessary to provide services or as required by law
Support Data Subject Requests: We provide tools to help you respond to data access, deletion, and portability requests

For debugging or support purposes, particularly when assisting users with issues they report, authorized TravelBuilderPro personnel may need to access specific account data to diagnose and resolve problems effectively.

6. Intellectual Property

Content Ownership

Your Content: You retain all rights to the travel itineraries, client data, branding materials, and content you create using TravelBuilderPro
Our Platform: TravelBuilderPro retains all rights to the software, platform features, and underlying technology
License: By using TravelBuilderPro, you grant us a limited license to host, store, and process your content solely for the purpose of providing our services

7. User Responsibilities

You agree to:

Use TravelBuilderPro only for legitimate travel agency business purposes
Not use the platform for any illegal activities or to transmit spam or malicious content
Maintain the confidentiality of your account credentials
Not attempt to reverse engineer, hack, or compromise the platform's security
Comply with all applicable laws and regulations in your jurisdiction

8. Service Availability

TravelBuilderPro strives to maintain 99.9% uptime. However, we do not guarantee uninterrupted access and may perform scheduled maintenance with advance notice. We are not liable for any downtime or service interruptions beyond our reasonable control.

9. Termination

Account Cancellation

You may cancel your subscription at any time through your account settings
Upon cancellation, you will retain access until the end of your current billing period
You may export your data at any time before or after cancellation
After 30 days of account inactivity following cancellation, your data may be permanently deleted

We reserve the right to suspend or terminate accounts that violate these terms or engage in fraudulent activity.

10. Limitation of Liability

TravelBuilderPro is provided "as is" without warranties of any kind. To the maximum extent permitted by law, TravelBuilderPro shall not be liable for:

Any indirect, incidental, or consequential damages
Loss of profits, data, or business opportunities
Damages resulting from your use or inability to use the service

Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Payment and Billing

Subscriptions are billed automatically on a recurring basis (monthly or annually)
Payment is processed through Stripe, our secure payment processor
You are responsible for maintaining valid payment information
Failed payments may result in service suspension
Refunds are provided at our discretion and typically limited to billing errors

12. Updates to Terms

We may update these terms from time to time to reflect changes in our services or legal requirements.

Your continued use of TravelBuilderPro after changes take effect constitutes acceptance of the updated terms.

13. Governing Law

These Terms of Service are governed by the laws of Spain. Any disputes arising from these terms or your use of TravelBuilderPro shall be resolved in the courts of Madrid, Spain.
